PTAB Invalidates USAA's Mobile-Banking Patents, PNC Challenges $218M Verdict

In a significant development, the Patent Trial and Appeal Board (PTAB) has invalidated all challenged claims in three mobile-banking patents owned by United Services Automobile Association (USAA). PNC, the defendant in a recent $218.5 million jury verdict, plans to use these rulings to contest the verdict.

The PTAB proceedings, IPRs 2021-01070, 2021-01073, and 2021-01077, targeted U.S. Patent Nos. 8,699,779, 8,977,571, and 10,621,559, respectively. PNC, represented by WilmerHale, successfully argued that these patents were invalid. The invalidated patents included all asserted claims in one of USAA's patents behind the $218.5 million jury verdict of infringement against PNC's mobile banking app in the district court case USAA v. PNC, 2:20-cv-00319 (EDTX). PNC was also represented by McKool Smith in the IPR proceedings.

With the PTAB's decision, PNC has grounds to challenge the $218.5 million verdict. The invalidation of the patents at the heart of the case could significantly impact the outcome of the ongoing legal dispute between USAA and PNC.
