Google's Advertising Division Escapes Antitrust Investigation by CCI
In a recent development, the Alliance of Digital India Foundation (ADIF) has accused Google of engaging in multiple anti-competitive practices in the online advertising space. The Competition Commission of India (CCI) has admitted ADIF's complaint and ordered a consolidated, wider probe into Google's conduct.
The allegations against Google are numerous. According to ADIF, the tech giant self-preferenced its own services within the AdTech ecosystem, tying and bundling its publisher ad server (DFP) with its ad exchange (AdX). Additionally, access to YouTube ad inventory is reportedly linked to the mandatory use of Google's demand-side platform (DV360).
ADIF also raised concerns about Google's practices regarding third-party technical support for advertisements and the restriction of 'Call Ads' on desktop platforms. Transparency in how ads are ranked and allowing competitors to bid on trademarked keywords are other allegations levelled against Google.
These allegations suggest that Google's dominant position in the market may be limiting competition by favouring its own products and restricting competitors' access or capabilities in the online display advertising market.
This is not Google's first brush with the CCI. In 2022, the CCI ordered a probe into Google for allegedly abusing its dominance in the news aggregation space. In the same year, the CCI also imposed penalties, totalling INR 2,200 Cr, on Google in two separate cases for abuse of its dominant position in the Android devices market and with regards to its Play Store policies.
ADIF has also expressed concerns over Google's Privacy Sandbox programme, stating that it would significantly hamper non-Google Demand Side Platforms' ability to serve advertisers effectively.
The Privacy Sandbox initiative aims to remove third-party cookies from websites accessed via the Google Chrome browser to address privacy concerns. However, ADIF claims that Google imposed unfair conditions on advertisers through its policies.
The Director General has been directed to investigate these alleged practices thoroughly. The outcome of this probe could have significant implications for Google and the online advertising industry in India.
